This law entered into force on December 6, 2018, replacing the old Organic Law 15/1999 on the Protection of Personal Data. The objective of the LOPDGDD is to adapt Spanish legislation to European regulations, defined by the General Data Protection Regulation (GDPR), effective as of May 25, 2018.
Therefore, if we talk about data protection in Spain, the reference standard is the LOPDGDD. This law establishes the requirements and obligations of companies on how to proceed with personal information, as well as the rights that users and consumers attend.
The purpose of the LOPDGDD is to protect the privacy, privacy and integrity of the individual, in compliance with article 18.4 of the Spanish Constitution. In the same way, it regulates the obligations of the individual in any process of data transfer to guarantee the security of the exchange. Personal information is considered to be information in text, image or audio that allows the identification of a person. There are data that are considered low risk, such as name or email, while others are considered higher risk, for example sensitive data related to religion or personal health.
